A. How to report intellectual property infringement

It is our policy to (1) block access to or remove any content — text, graphics, photos, designs or listings ("Content") — that we believe in good faith infringes the intellectual property rights of a third party, once we receive a compliant notice, and (2) remove and discontinue service to repeat infringers.

If you believe Content on this store infringes your copyright, or that your intellectual property rights have otherwise been violated, please send a notice of infringement containing all of the following to our designated agent:

  • Identification of the copyrighted work or other intellectual property you claim has been infringed, including any registration number that applies to it.
  • Identification of the Content you claim is infringing, including (a) how it uses the protected work in a way that constitutes infringement, and (b) where it appears on our store, with enough detail for us to locate it.
  • Your contact details: full name, mailing address, telephone number and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorised by the rights holder, its agent or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or are authorised to act on the rights holder's behalf.
  • An electronic or physical signature of the person authorised to act on behalf of the rights holder.

B. What happens once a valid notice is received

When our designated agent receives a bona fide notice of infringement, it is our policy to remove or disable access to the allegedly infringing Content and to notify the party who posted it. You will receive an acknowledgement at the email address you provide, quoting your reference number.

C. How to submit a counter-notice

If Content you posted was removed or disabled and you believe it is not infringing, or that you are permitted to use it by the rights owner, the owner's agent or the law (including fair use), you may send a counter-notice to our designated agent containing the following:

  • Identification of the Content that was removed or disabled, including where it appeared on the store before removal.
  • A statement, made under penalty of perjury, that you have a good-faith belief the Content was removed or blocked as a result of a mistake or misidentification.
  • Your contact details: full name, mailing address, telephone number and email address.
  • A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or — if your address is outside the United States — of any judicial district in which we may be found.
  • Your electronic or physical signature.

If we receive a counter-notice, we may send a copy to the original complaining party, informing them that we may restore the removed Content in 10 business days. Unless the rights owner files an action seeking a court order against the party who posted the Content, we may restore it, at our discretion, within 10 to 14 business days of receiving the counter-notice.

D. Repeat infringers

We take intellectual property seriously. Accounts and suppliers found to have repeatedly infringed the rights of others will have their access removed and their service with us discontinued.

E. A note on false claims

Under Section 512(f) of the DMCA, any person who knowingly makes a material misrepresentation that Content is infringing — or that it was removed by mistake — may be liable for damages, including costs and legal fees. Please make sure your claim is accurate before submitting it, and consider seeking legal advice if you are unsure.
